General Information

Rome is the capital city and most populated comune (municipality) of Italy. It is also the administrative centre of the Lazio region and of the Metropolitan City of Rome. A special comune named Roma Capitale with a population of 2.7 million in an area of 1,287.36 km2 (497.1 mi2), Rome is the third most populous city in the European Union by population within city limits. The Metropolitan City of Rome Capital, with a population of 4.2 million, is the most populous metropolitan city in Italy. Its metropolitan area is the third-most populous within Italy. Rome is located in the central-western portion of the Italian Peninsula, within Lazio (Latium), along the shores of the Tiber Valley. Vatican City is an independent country inside the city boundaries of Rome, the only existing example of a country within a city. Rome is often referred to as the "City of Seven Hills" due to its geography, and also as the "Eternal City". Rome is generally considered to be one of the cradles of Western civilization and Western Christian culture, and the centre of the Catholic Church.

Liti temerarie, il governo recepisce la direttiva Ue, ma esclude il 90% dei casi. La protesta: “Risultato deludente, hanno rifiutato ogni confronto”
In ritardo e ignorando le raccomandazioni Ue, il governo Meloni ha recepito la direttiva contro le azioni legale temerarie ai danni di giornalisti, attiviste e whistleblower. Un atto atteso (e dovuto) da maggio scorso e che, invece di allargare le tutele per chi si occupa di fatti di interesse pubblico, ne ha ristretto ancora di più l’applicazione. In attesa della pubblicazione del testo in Gazzetta ufficiale, protesta Case Italia, il gruppo di lavoro italiano della Coalition Against SLAPPs in Europe che riunisce 17 organizzazioni. Andando, infatti, in direzione opposta rispetto qualsiasi buona pratica usata dagli altri Stati, il governo italiano non ha mai coinvolto la società civile nella discussione sul provvedimento, tanto che l’unica audizione riservata a loro in Parlamento ha visto la partecipazione di soli tre parlamentari M5s e le osservazioni non sono mai state recepite riducendo il processo a “un mero esercizio formale“. “Il nostro Paese”, ha commentato la portavoce Sielke Kelner, “arriva in ritardo, dando un esempio che rischia di trasformarsi in una vera e propria bad practice a livello europeo. Riteniamo che questo risultato così deludente sia anche il riflesso del rifiuto di un confronto effettivo con le componenti più rilevanti della società civile”. Come le organizzazioni denunciano da mesi, il governo ha prodotto un atto che non solo si limita a recepire al minimo quanto richiesta da Bruxelles, ma addirittura restringe la portata delle tutele in un Paese che è in cima alle classifiche per numero di azioni temerarie: “Si lasciano fuori”, denunciano, “nove casi su 10“. Il decreto italiano, spiega Case, “offre protezioni solo ai bersagli di azioni legali temerarie con implicazioni transfrontaliere, escludendo di fatto le controversie domestiche, che rappresentano almeno il 90% dei casi registrati”. La stessa direttiva aveva invece una nozione di caso transfrontaliero più ampia, in quanto il testo Ue “stabilisce che un caso può essere considerato transfrontaliero anche quando, ulteriori elementi rilevanti della fattispecie presentano collegamenti con un altro Stato”. Il riferimento è all’articolo 5, dove si richiede che “una controversia possa considerarsi priva di implicazioni transfrontaliere soltanto quando, oltre al domicilio delle parti nello stesso Stato membro, tutti gli ulteriori elementi pertinenti alla situazione siano situati unicamente in tale Stato”. Proprio questa formulazione permetteva di ampliare l’applicazione del testo, ma il governo Meloni ha deciso di non procedere. L’applicazione della direttiva, inoltre, riguarda esclusivamente i procedimenti civili, mentre lascia fuori quelli penali, inclusi i procedimenti per diffamazione, “tra gli strumenti più usati contro chi informa o critica in Italia”. Secondo Case, la scelta “solleva dubbi” anche rispetto al minimo richiesto da Bruxelles. Kelner ha quindi annunciato che Case Italia “porterà all’attenzione della Commissione europea le principali criticità del decreto, affinché venga valutata la conformità rispetto agli obblighi previsti dalla direttiva”. Senza dimenticare che la Commissione ha già inviato all’Italia una lettera di richiamo per il mancato recepimento entro il termine del 7 maggio. E senza dimenticare che già Commissione europea e Consiglio d’Europa, rispettivamente nel 2022 e 2024, hanno invitato i Paesi Ue ad ampliare le tutele contro le azioni temerarie. La coalizione, il prossimo 22 ottobre, scenderà in piazza Capranica a Roma (dalle 10 alle 13) “per protestare contro una legge incapace di difendere la libertà di espressione”: “Chiederemo al governo e al Parlamento di intervenire per correggere una normativa che rischia di lasciare senza protezione la grande maggioranza delle vittime di SLAPP”. Una manifestazione che cade a pochi giorni dopo l’anniversario dell’assassinio della giornalista maltese Daphne Caruana Galizia che, al momento della morte stava fronteggiando una cinquantina di SLAPP, molte delle quali avviate da esponenti del governo maltese. Proprio in suo onore la direttiva Ue contro le azioni atemerarie era stata ribattezzata “legge Daphne” e scritta con il contributo della famiglia perché nessun giornalista o attivista debba più subire intimidazioni.
